Heard learned counsel for the applicants and learned APP for the State.

The applicants seek bail in Crime No.175 of 2024 registered with Cantonment (Chawani) Police Station, District Aurangabad for the offence punishable under Sections 307, 323, 504 r/w 34 of the Indian Penal Code.

Perused the FIR. Though allegations have been levelled against the applicants that two persons were injured, only one has suffered injury by the wooden bat. It was a dispute of talking with the sister of applicant no.1. There was a counter case. The investigation has been completed as regards recovery of the weapon.

962-ba-789-2024.odt (2) The injured has been discharged. There is no harm to the life of the injured. There are no antecedents to the discredit of the applicants. It seems to be a quarrel happened at the spur of moment. The applicants are young boys. For the reasons mentioned above, they deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicants, Ajij Deshmukh @ Ajju and Rehan Shaikh Feroz, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of the like amount in the above crime, on the conditions that;

(a) The applicants shall not involve in similar crime. (b) The applicants shall attend the concerned police station as and when called on written notice by the investigation officer till filing the charge sheet.
