Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers on record. 2.
Crime bearing No. 0065 of 2025 is registered with Goregaon Police Station, District Hingoli, for offences punishable under Sections 118(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, against the Applicant and the co-accused. Since the Applicant is apprehending arrest, he has preferred this Application for grant of anticipatory bail.

On account of a dispute in relation to felling of trees, the incident took place in the evening of 03.03.2025. The Applicant caught hold of informant, and the co-accused assaulted the informant with an
2 951ABA723.2025.odt Axe. The informant was hospitalized. Though the report shows that the informant's statement was recorded in Vitthal Multispeciality Hospital, the said report did not reach the concerned Police Station. The report on the basis of which the above-referred Crime was registered, is lodged after a period of one [1] month. There is prior report to the said Police Station upon which Crime No. 0043 of 2025 came to be registered for offences punishable under Sections 351(2), 352, 115(2), 333, 118(1), 190, 191(3), 191(2) and 189(2) of the Bharatiya Nyaya Sanhita, 2023, on the report lodged by co-accused on 09.03.2025 for the same incident. 4.
The co-accused to whom the role of assault by an axe is attributed is released on regular bail by this Court. The Applicant has been protected by an interim order dated 09.05.2025. The investigation is almost over. It is nobody's case that the Applicant has misused the liberty. Considering these aspects, I am inclined to confirm the interim protection. Hence, the following order.
ORDER
[i] The interim protection granted to the Applicant vide order dated 09.05.2025 is confirmed.
[ii] Application stands disposed off.
