DATED : 15 th June, 2015 PER COURT :- 1] At the out set learned counsel for applicant Shri V.P.Savant submits that he has instructions to withdraw the application for applicant no.2-Ganesh Sakharam Dalve. Application for applicant no.2-Ganesh Sakharam Dalve is dismissed as withdrawn.
2] The first information report is lodged by Nilawati Dhade on 30.1.2015. From the first information report, it is clear that the cell phone call was made to her son Mariba Dhade by Ganesh Dalve, which is also supported by the C.D.R. record seized by the investitgating officer. From the investigating papers, it does not appear that there is any pressing incriminating material against applicant no.1-Kishor s/o Sakharam Dalve. Hence, application for Kishor Sakharam Dalve can be considered favourably. That leads me to pass the following order.
O R D E R
(i) Application for anticipatory bail filed by applicant no.2-Ganesh Sakharam Dalve is dismissed as withdrawn.
crap2551.15 (ii) Application for anticipatory bail filed by Kishor Sakharam Dalve is allowed.
(ii) Kishor Sakharam Dalve, In the event of his arrest by police station Pimpalner, District Beed, in connection with Crime No. 6 of 2015, for the offences punishable under Sections 436, 457, 380 r/w 34 of the Indian Penal Code and Section 3(1) (ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, be released on anticipatory bail on he executing P.R. bond of Rs. 25,000/- with two solvent sureties in the like amount.
(iii) Applicant-Kishor Sakharam Dalve shall attend police station Pimpalner, District Beed twice in a week on every Sunday and Tuesday in between 3.00 p.m. to 5.00 p.m. till the charge sheet is filed.
(iv) Criminal Application is disposed of.
