We have heard Mr. Muneshwar, the learned counsel for petitioners. The learned counsel submits that, the petitioners are share holders of the respondent No. 4/sugar factory. The said sugar factory is sold for the recovery of the dues and the same is purchased by the respondent No. 3/Karkhana. Shares of the present petitioners are required to be protected. The respondent No. 3 be directed to treat the present petitioners as share holders.

The assets of the respondent No. 4 are purchased by the respondent No. 3. This Court cannot consider the grievance raised by the present petitioners, as the sale of the assets has

2 wp 6102.13 already taken place and the respondent No. 3 has purchased the assets of the respondent No. 4. The respondent No. 3 would be governed by the terms and conditions of the sale effectuated. 3.

The petitioners, if, so desire may take up appropriate proceedings before the concerned authorities. The writ petition as such is disposed of. No costs.
