The petitioner who was not a party to the Original Application No.127/2018 decided by the Maharashtra Administrative Tribunal on 29.10.2018, sought its review by preferring Review Application Stamp No.42/2023 with M.A. No.14/2023 in O.A. No.127/2018. By the impugned order, the Tribunal has refused to entertain the Review Application. It has not adverted to the merits of the matter.

In view of the decision in the matter of K. Ajit Babu and Others Vs. Union of Indian and Others, reported in (1997) 6 SCC 473, the learned Advocate for the petitioner on instructions, seeks leave to withdraw the writ petition with liberty to file a fresh original application before the Tribunal.
