Applicant is claiming withdrawal of amount as the respondent No. 1 has deposited an amdount of Rs. 3,48,645/-. Appeal filed by the respondent No. 1 is not likely to be heard finally within years to come. It is desirable to permit the applicant to withdraw 70% of the amount deposited. The civil application is allowed partly by permitting the applicant to withdraw 70% of the amount deposited by furnishing usual undertaking before this Court to the satisfaction of the Registrar (Judicial).
