The petitioner approached this Court with the present Writ Petition dated 23rd May, 2012, with a prayer, inter-alia, for absorption in service.

Mr. P.P. Mandlik, learned Advocate appearing for the petitioner, however, submits that the petitioner's service has since been terminated by his employer and pursuant to leave granted by a co-ordinate Bench of this Court dated 7th March, 2018 while disposing of his previous Writ Petition (Writ Petition

2 WP / 4441 /2012 No. 3265 of 2013), the petitioner has approached the forum available under the Industrial Disputes Act, 1947 for redress. 3.

In view thereof, this Writ Petition stands dismissed. 4.

If indeed, the petitioner succeeds before the Labour Court and the cause of action for seeking similar relief as claimed in this Writ Petition still subsists, he shall be at liberty to approach this Court once again with a fresh Writ Petition. [RAVINDRA V. GHUGE, J.] [ CHIEF JUSTICE ] arp/
