The Petitioner Union seeks implementation of a clause under a settlement/agreement, signed by the Union with the Respondent No.2 employer.

The Petitioner can either raise an industrial dispute under Section 2(k) of the Industrial Disputes Act, 1947 or move a ULP complaint under item 9 of Schedule-IV of the MRTU and PULP Act, before the Industrial Court at Jalgaon.

In view of the above, this Writ Petition is disposed off with liberty to the Petitioners to approach the appropriate forum for seeking implementation of the agreement/settlement. 4.
