Heard learned Advocates for the parties for some time. This petition is against an inquiry report of the learned Collector prepared under section 341 (B-5) of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Township Act, 1965. Though the learned Advocate for the petitioner tried to argue that this petition can be entertained by this Court as the learned Collector has recorded some findings in the said report and the State Government has to pass order under Section 55A of the Act based upon said report, this can very well be challenged in this Court. As on today, no order is passed neither this report can be stated to be an order passed by the learned Collector. This Court finds that this petition is premature and hence dismissed.
