Mr. Katneshwarkar, the learned counsel for the petitioner submits that, the respondents are not handing over possession of auctioned machineries purchased by the petitioner. This Court had disposed of the earlier writ petition bearing No. 7067 of 2005 observing that, old machines from Blow Room, Carding and Compressors have been disposed of and the auction purchaser would be entitled to take those machines.

Mr. Choudhari, the learned counsel for the respondent submits that, the respondents does not have any objection for the petitioner to take possession of the old machines of the Blow Room which he has purchased in auction. The affidavit in reply states that, the respondents does not have any objection to the same. 3.

In light of that, the respondents shall hand over the machines purchased by the petitioner in auction and as per the certificate of sale dated 28th September, 2005, expeditiously. 4.
