ORDER

Learned Counsel Mr. S.S. Rathi for the appellant along with Prasad Raut, Senior Executive (Legal) Shriram General Finance Co. Ltd. - representative of the appellant and learned counsel Mr. Madde holding for learned counsel Mr. Shinde for the respondent no. 1 along with respondent no. 1/ original claimant Mr. Suryakant Tulsiram Panchavate, are present today.

With the assistance of learned counsel, the identification of claimant Mr. Suryakant Tulshiram Panchavate is made. He confirms the terms of settlement arrived at between the parties. It is further ascertained that there is no any other claimant.

The parties have arrived at terms of settlement and the same is placed on record which is marked as exhibit 'X'. In view of terms of settlement, they are praying for disposing of the appeal.

As per the terms of settlement filed today, the respondent / claimant is permitted to withdraw an amount with accrued interest already deposited in this Court, except Rs. 3,30,000/- (Rupees three lakhs thirty thousand) out of the same. The appellant shall receive Rs. 3,30,000/- (Rupees three lakhs thirty thousand) from the deposited amount.

The appeal is disposed of in view of the terms of settlement and present minutes of order. The office shall refund court fees as per rules.
