After arguing for some time, when this Court was not inclined to grant relief, learned advocate for the petitioner, on instructions, seeks permission to withdraw the writ petition with liberty to file application for referring the issue of tenancy to the Tenancy Court, after parties lead their evidence. 2.

Permission granted.

Writ petition is dismissed as withdrawn with liberty as prayed for.

Needless to mention that the order impugned in the present petition shall not come in the way of the petitioner, if such application is filed by the petitioner, after leading evidence, the Trial Court shall consider such application on its own merits and without being influenced by the order impugned in the present petition.
