Mr. Sant, learned counsel for the petitioner submits that the petitioner would approach the Court under Section 34 of the Arbitration and Conciliation Act challenging the Award. The challenge to the Circular dated 21.12.2020 be kept open.

The petitioner is at liberty to avail the remedy under Section 34 of the Arbitration and Conciliation Act as may be available to them. The petitioner in appropriate proceedings is at liberty to assail the Circular dated 21.12.2020. The petitioner may assail it in independent proceedings.

The petitioner may also approach the Authority with regard to the Circular referred to above as may be permissible in law.
