In view of judgment of this Court, in the matter of Abhijit Bhikaseth Auti vs. State of Maharashtra & anr., reported in 2009 (1) BCR (Criminal) 845, learned Counsel appearing on behalf of the petitioner, upon instructions, seeks leave to withdraw the present petition, with liberty to prefer an appeal before learned Sessions Judge. Leave granted. 2.

If an appeal is presented within a period of one week from today, the appellate court shall ignore the delay caused in preferring appeal, particularly in the background of pendency of the petition before this Court. 3.

With above observations, Criminal Writ Petition stands disposed of as withdrawn, with liberty as prayed for.
