Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0522/2020, registered at Amalner Police Station, District Jalgaon for the offence punishable under Sections 392, 506 read with Section 34 of the Indian Penal Code and Sections 3/25 of the Arms Act.

The accused were unknown to the informant. Their names have been given in the F.I.R. since according to the informant, both of them were calling each other with the names given in the F.I.R. itself. On arrest of the applicant, no

test identification parade has been held. On investigation, charge sheet has been filed. The applicant is just 23 years of age. True, he has criminal antecedents, and the learned A.P.P. may have reason to urge for rejection of the bail application. However, the aforesaid observations lead this Court to grant bail to the applicant. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.0522/2020, registered at Amalner Police Station, District Jalgaon for the offence punishable under Sections 392, 506 read with Section 34 of the Indian Penal Code and Sections 3/25 of the Arms Act, if not required in any other crime, on his furnishing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. (ii) The applicant shall not tamper with the prosecution evidence.
