Heard learned counsel for the applicant and learned A.G.P. for the respondent No.1/State and learned counsel Mr. M.N. Navandar, Advocate for respondent No.2. Perused the application.

In view of the reasons mentioned in the application, I do not find any impediment to condone the delay of 94 days caused in filing first appeal in the interest of justice. Hence, the application stand

2 CA 8702/16 allowed in terms of prayer clause 'A'. In view of this, the delay caused in filing the First Appeal is hereby condoned.

Registry to take requisite steps for further process.

On registration of Appeal, issue notice to the respondents. Learned A.G.P. waives service of notice on behalf of respondent No.1-State and learned counsel Mr. M.N. Navandar waives service of notice o behalf of respondent No.2-acquiring body.

Call Record and proceedings from the concerned reference Court.

7.

After compliance of the proper formalities, list the appeals for hearing at the stage of admission in due course.
