We have heard the learned Advocate for the petitioner and the learned AGP for the respondents.

We are informed that in identical set of facts, this Court (Coram : S.V.Gangapurwala and Shri R.G.Avachat, JJ.) had passed an order dated 23.7.2020 in Writ Petition (St) No.12195 of 2020 (Supriya Pralhad Bhutte Vs. State of Maharashtra and others) along with another petition. It is contended that even in this case, the impugned communication shifting the petitioner to the supernumerary post, dated 18.3.2020, is passed without hearing the petitioner.

In view of the above, we issue the same direction, as has been done earlier in our order dated 23.7.2020 (supra). A.K.Losarwar, PS

In the result, the impugned order dated 18.3.2020 is quashed and set aside. Since the claim of the petitioner for validation is pending from 19.9.2013, we direct that the third respondent shall decide the claim of the petitioner as expeditiously as possible and in any case, on/or before 15.11.2020. The petitioner shall appear before the Committee on 5.9.2020.
