Rule. Rule made returnable forthwith and heard finally with consent of learned advocates for the parties. These writ petitions have been moved against orders dated 31st January, 2014 rejecting applications Exhibit-25 in Regular Civil Suit No. 49 of 2014 and Exhibit-24 in Regular Civil Suits No. 50 of 2014, 52 of 2014 and 51 of 2014 pending before 4th Civil Judge, Junior Division, Nanded seeking adjournment / time in order to enable the petitioners to obtain permission pursuant to section 107 of the Maharashtra Co-operative Societies Act, to prosecute proceedings pending before civil court. It is further
{4} pointed out that during pendency of said civil proceedings, the parties were directed to maintain status quo. During pendency of civil proceedings, the petitioners had moved the District Deputy Registrar, Co-operative Societies, Nanded under the Maharashtra Co-operative Societies Act, seeking permission pursuant to section 107 of said enactment, however, the proceedings did not bear any fruits. The petitioners then had moved revision before Divisional Joint Registrar, Cooperative Societies, Latur which was dismissed. As such, the petitioners had moved writ petition No. 8975 of 2014 before this court. Said petition has been allowed by this court on today i.e. 14th July, 2015.

In view of the decision in writ petition No. 8975 of 2014 the writ petitions stand allowed in terms of prayer clause "B". Rule is made absolute accordingly. It would be open for the parties to prosecute proceedings before the trial court, including for interim relief.
