PER COURT :- 1.

The applicants by this application pray for condonation of 21 days' delay caused in filing the Civil Application for bringing on record the legal heirs of deceased Ramdas - respondent No.1B to the Second Appeal.

Reasons in support are in paragraph Nos. 3 and 4. 3.

Learned Advocates for the respondents opposed the application on the ground that the reasons cited do not support the request for condonation of delay.

Having considered the submissions of the rival sides, this application is allowed. Delay of 21 days is condoned, subject to the applicants depositing costs of Rs.1,500/- in this Court within a period of three weeks from today, failing which this order shall stand recalled and the civil application shall stand rejected.

Upon depositing costs, the applicant shall bring on record the legal heirs of the deceased respondent No.1B - Ramdas within a period of three weeks therefrom. Costs deposited shall be withdrawn by the respondents in equal proportions.
