DATE : 18th July, 2017 ORAL ORDER After having heard respective Counsels for some time, this Court was not inclined to entertain the Revision Application on merit. 2.
Learned Counsel for the applicant has come out with an undertaking, signed by Rajesh son of petitioner. According to him, the petitioner, in view of his ill-health (indisposed), is unable to travel and attend the proceedings in this Court for filing undertaking. With this undertaking, he further states that he is authorised to file undertaking as he is residing jointly with the applicant. He undertakes that he shall
CRA 112-2017 (2) vacate the suit premises on 31st January 2018 though it is mentioned in the undertaking that time till 31st March 2018 be granted. 3.
As the applicant has undertaken to vacate premises by 31st January 2018 and further undertakes to pay regular rent till then, as agreed between the parties, the undertaking is accepted. Single default in payment of rent will entail the respondent to execute the decree. 4.
The applicant shall maintain premises in appropriate condition. 5.
Revision Application stands disposed of accordingly. ( N.W. SAMBRE, J.) pjm
