Heard the learned counsel for the applicant and the learned APP for the respondent-State.

This is the second bail application. However, there were no change-in-circumstances that make out the case for bail. Hence, the Court expressed disinclination to grant bail. The learned counsel for the applicant, on instructions, seeks leave to withdraw the bail application.

Leave granted.

However, the learned counsel for the applicant would submit that the applicant is the only elder male member in his family. Angiography of his mother is scheduled on 26.06.2023. Therefore, one week temporary bail may be granted to him to attend the hospital and look after his mother.

In view of the facts and the statement made by the learned counsel for the applicant, no harm would be caused to the prosecution, if temporary bail for one week is granted to the applicant. Hence, the following order :

O R D E R

(i) Bail application stands dismissed as withdrawn. (ii) Applicant GANESH SAMPATI MENDAKE be released on temporary bail from 26.06.2023 to 30.06.2023 on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.590 of 2022, registered by Police Station Taluka Jalna, District Jalna, for the offence punishable under Section 20 of the N.D.P.S. Act. (iii) The applicant shall surrender before the learned District Judge-7 and Additional Sessions Judge, Jalna on 01.07.2023 at 10.00 a.m.
