Present application is filed for withdrawal of amount. 2.

It is stated that, amount of Rs.12,37,112/- is said to be deposited before the Commissioner for Employee's Compensation and Judge, Labour Court, Nanded. The applicant suffered 100% loss in earning capacity due to the accident, and therefore, definitely certain amount is required to be released for his survival, and at the same time, the interest of the present respondent No.1 deserves to be protected.

Accordingly the applicant is allowed to withdraw amount of Rs.7,30,000/- out of the said amount which has been deposited before

CA 6408-2019 the learned Commissioner for Employee's Compensation and Judge, Labour Court, Nanded, upon submitting undertaking before this Court on or before 12-07-2019 that, he is make good the said amount, in case directed at the time of final disposal of the first appeal.
