The applicant is apprehending arrest in connection with Crime No. 0026 of 2018 registered with Parli City Police Station, Parli-Vaijnath, Dist. Beed, for the offence punishable under Sections 420, 409, 468, 470, 471, 474, 109 r/w 34 of the Indian Penal Code. 2.

It is brought to the notice of this court that the informant has recorded a supplementary statement wherein it is categorically stated that the present applicant is not responsible for any irregularities. Apart from this, prima facie perusal of the investigation papers shows that there is no other evidence in order to hold that the applicant is involved in alleged crime. Hence, the application is allowed in terms of interim order passed by this Court vide order dated 28th April, 2023.

At this stage, the learned counsel for the applicant submits that in view of the statement made by informant, he may be permitted to withdraw Rs.73,604/- deposited by him pursuant to order dated 28th April, 2023.

While filing charge-sheet, if applicant is arraigned as an accused, it is open for him to withdraw the amount deposited with the office of Sub-Divisional Agricultural Office, Ambajogai. [ R. M. JOSHI ] JUDGE SG Punde 2/2
