In fact the petitioner ought to approach the Executing Court. It is submitted by the learned senior advocate that the petitioner has already filed an application Exh.32 before the Executing Court, however no orders are passed on it as yet.

In case, the application Exh.32 (Page No.75) is pending with the Executing Court, the Executing Court shall take decision upon it on its own merits in accordance with law
