The applicant seeks bail in Crime No.139 of 2024 registered with Dharashiv (City) Police Station, District Dharashiv (Osmanabad) for the offence punishable under Sections 307, 341, 143, 147, 148, 149 of the Indian Penal Code.

The FIR has been lodged by the injured who is a journalist. However, he did not state about the assault by the sickle. The witnesses said that he has been assaulted with sickle. However, the injury certificate does not corroborate the use of the sickle. The injury suffered to the injured is simple in nature. The CCTV has been allegedly recovered but its transcription has not been produced. The conviction of the applicant in POCSO case appears to have no direct

963-ba-796-2024.odt (2) connection with the present crime. The material investigation has been completed. No purpose would be served by keeping the applicant behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Premkumar Sukhdeo Bansode, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the concerned police station as and when called on written notice by the Investigation Officer till filing the charge sheet.
