Learned counsel for the applicant submits that as per clause 7 of the agreement executed in the month of February, 2003, in case of any dispute, the matter shall be referred to mutually acceptable Arbitrator. Learned counsel for the applicant, on instructions, submits that during pendency of this arbitration application, by consent of both the parties, mutually the Collector, Latur is appointed as an Arbitrator.

In view of above submission, arbitration application is disposed of. No costs.
