Heard Mr. Kuldeep Patil holding for Mr. S.S. Chaudhari, learned counsel for the applicants.

Even though there seems to be inordinate delay in bringing the legal heirs of the deceased appellants Khaderao Pokale and Sushilabai Pokale, the application needs to be allowed by setting aside the order of abatement in view of amicable settlement between the parties.

(i) The application is hereby allowed in terms of prayer clause (B).

(ii) The appellant to carry out the amendment forthwith.
