Applicants apprehend arrest in connection with with C.R. No. 22 of 2023 registered with Latur Rural Police Station, Dist. Latur for the offences punishable under Sections 20(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985.

Learned Counsel for the Applicants states that except for the statement of co-accused there is absolutely no evidence on record to connect with him with crime.

Learned APP opposed the application.

It is not in dispute that the charge-sheet already filed. Except for the statement of co-accused

938-ABA-666-2023.odt there is no evidence to show involvement of the Applicants in the crime. Needless to say that statement of the co-accused cannot be proved in evidence. For want of any material to connect Applicants with this crime, and since nothing is left to be investigated in the crime, the Application deserves to be allowed. Hence, application is allowed by confirming order dated 04th May, 2023.
