It appears that notice to the appellant on Court motion was issued for securing his presence, but the same returned unserved with reason that he was not found on given address. The alternate address is also not provided and therefore, this Court vide order dated 15th December 2023 has fixed this appeal for dismissal for want of steps. Further, the learned Advocate for the appellant had already received instructions that the impugned decree is already executed. The said fact is reflected in the order dated 21.09.2023 in this matter. As such, the second appeal stands dismissed for want of steps alongwith the pending civil application No. 181 of 2014 and accordingly disposed of.
