Heard the learned counsel for appellant, learned APP and the learned appointed counsel for respondent No.2. The learned APP submits that during the pendency of this appeal, charge-sheet has been filed against the appellant and as per the procedure, after filing of the charge-sheet, the appellant has to file regular bail application before the Trial Court. Considering the submissions of the learned APP, the learned counsel for appellant, on instructions, seeks leave to withdraw this appeal with liberty to file an application before the Trial Court. The learned counsel for appellant further submitted that directions be given to the Trial Court to decide the bail application filed by the appellant in a particular time.

940 APPEAL.442.2024.odt Considering the submissions of all the learned counsel, leave granted. The criminal appeal is disposed of as withdrawn with liberty as prayed for.

If the appellant files an application for bail before the Trial Court, the Trial Court is requested to decide the same as early as possible. The fees of the appointed counsel be paid through the High Court Legal Services Sub-Committee, Aurangabad as per Rules and schedule.
