The applicant is seeking pre-arrest bail in Crime No. I-36 of 2016 registered at M.I.D.C. Police Station, Dist. Ahmdnagar for an offence punishable under Sections 381, 408 read with Section 34 of the Indian Penal Code.

It is the case of the applicant that he is neither employee of the complainant's company nor any way related with the crime in question and is falsely implicated.

Learned Counsel for the applicant would then submit
2515.16crapln -2that stolen articles i.e. Cars in question are already recovered and as such, custodial interrogation of the applicant is not necessary. 4.
Learned A.P.P. based on the investigation carried out would submit that prima facie involvement of the applicant is apparent from the investigation as is carried out till date. Learned A.P.P. so as to confirm that the investigation is carried out in proper manner has relied upon the statement of co-accused namely Pradip and other material on record.

Perusal of the investigation papers would depict that the investigation as is carried out would reflect prima facie involvement of the applicant in the crime in question, which is serious offence of theft of unregistered vehicles from the godown of the vehicle dealer. 6.
In view of above, no case for grant of pre-arrest bail is made out. The application fails, stands rejected. [ N.W. SAMBRE, J. ] Tupe/06.06.16
