Heard the learned counsel Mr. Shirsath for the petitioner. The petitioner challenges the order declaring the petitioner surplus and thereby transferring the petitioner. In fact the petitioner approached the Additional Commissioner. The Additional Commissioner had remitted the matter to the Block Education Officer. The Block Education Officer decided the same against the petitioner. The petitioner approached the Chief Executive Officer. The Chief Executive Officer under order dated 09.05.2019 also upheld the order of the Block Education Officer.

In view of that the petitioner may approach the Commissioner with all the facts. Upon the application being received from the petitioner the Commissioner shall take decision upon it within four weeks from the date of receipt of the application on its own merits.

The Writ Petition is disposed of. No costs.
