Mr. Hon, learned Advocate for petitioners submits that the salary is not being paid to the petitioners as per 6th Pay Scale from the date of their appointments. The respondents be directed to pay regular salary as per the 6th Pay Scale alongwith the arrears.

Mr. Kakade, learned advocate for the respondents, on instructions of In-charge Director Mr. Qureshi, submits that the Institution has paid the salary as per 6th Pay Commission till July, however Dearness Allowance was paid at the rate of 51%.

2 wp 6004.17 The learned advocate submits that the complete salary as per 6th Pay alongwith admissible Dearness Allowance (after adjusting the Dearness Allowance already paid) would be paid within one week from today. The learned advocate further submits that the salary as per 6th Pay Commission with admissible Dearness Allowance from December-2017 will be paid expeditiously and for that purpose budgetary provisions are being made. Within three to four months the steps would be taken to pay the same. The learned advocate submits that the respondents would pay the petitioners the salary as per 6th Pay Commission and the Dearness Allowance at the rate of 51% for the current year and the arrears would be cleared within three to four months. The said statement is accepted.

In view of the aforesaid statement, the writ petition is disposed of. No costs.
