The applicant prays that the order dated 28/04/2016 be recalled considering the fact that the petition is dismissed in default on the first date of hearing prior to issuance of notice to the respondent. It is submitted that the learned Advocate for the petitioner could not remain present before the Court. 2.

In the light of the above, this application, which is filed within limitation, is allowed. The order dated 28/04/2016 is recalled and Cri.W.P.No.535/2016 is restored.
