The learned counsel for the petitioner, on instructions from his clients, seeks leave to withdraw the present petition. However, he submits that directions be issued to the learned District Judge, Osmanabad, to decide the Exhibit 5 application in MCA No.04/2019. 2.

Since this Court had not issued notice in the matter, liberty is granted to the petitioner to make an appropriate application seeking early disposal of MCA No.04/2019. If such an application is filed, the concerned District Judge shall decide the application in accordance with the law. 3.

With the above observations, the petition is dismissed as withdrawn.
