Mr. Jayabhar, the learned advocate states that, statement was made in the Writ Petition No. 11487 of 2016 by the respondents that, they will allot the shops by auction, however, no auction was held and the shops were allotted by the Sarpanch and Gram Sevak privately.

The affidavit is filed by the respondent No. 5 stating that auction proceeding was initiated for allotment of the shops in

2 cp 453.17 question. The auction notice was published/affixed in office of Gram Panchayat, Panchayat Samiti, Bazar chowk. Even many persons participated in the said auction.

Present contempt petition is filed on the premise that the respondents did not abide by their statement and sold the property dehors the auction. Considering the affidavit filed, it is manifest that the auction was held. In the contempt petition, we cannot go into merits and demerits of the auction conducted. If, the petitioner is aggrieved by the auction, it is for the petitioner to assail the said auction in appropriate proceedings. Considering the above contempt petition is disposed of. No costs. [S.
