Mr Ladda, learned Counsel, appearing for the appellant, fairly submits that erroneously the appeal is presented before this Court and considering the issue involved in the appeal, appeal ought to have been filed before the Honourable Apex Court. Learned Counsel prays for withdrawal of the appeal with liberty to approach the appropriate Forum, namely, the Honourable Apex Court. Appellant is allowed to withdraw the appeal with liberty, as prayed.
