Present application has been filed for withdrawal of the amount. Respondent No.1 has deposited amount of Rs.3,32,320/-. The appeal has been filed on the ground that no opportunity was given to respondent No.1 to contest the matter. Since it is an injury claim and at present respondent No.2 has been held to be negligent and the compensation has been awarded, case is made out for partial withdrawal of amount.

Applicant is allowed to withdraw amount of Rs.1,50,000/- by submitting undertaking that he
