The learned counsel appearing for the respondent No.5 submits that, this petition was filed by the petitioner, challenging the rejection of the stay application, in the appeal filed by him, before the Additional Commissioner, Aurangabad. However, in the meantime, the main appeal itself has been decided by the Additional Commissioner, Aurangabad in favour of petitioner and the respondent No.5 has filed writ petition challenging the said decision in Writ Petition No.12077 of 2017.
