Advocate for Petitioner : Mr. Joshi Hrishikesh A AGP for Respondents : Mr. A.R. Kale Advocate for Respondent Nos.1, 3, 4 & 5 : Mr. U.S. Malte ...
CORAM : R.D. DHANUKA & S.G. MEHARE, J.J.
DATED : 28th APRIL, 2022 PER COURT.:- 1.
By this contempt petition, the petitioner seeks a writ of mandamus to release the pensionary and other benefits such as gratuity etc. There is no prayer for initiating any action under the provisions of the Contempt of Courts Act, 1971. 2.
Be that as it may, the respondents have already decided the representation made by the petitioner by order dated 07.02.2017. The petitioner has not even impugned the said order. 3.
In our view, there is no contempt committed by any of the respondents. The contempt petition is accordingly dismissed. No order as to costs.
4.
It is however made clear that we have not gone into the 1/2
909-cp-475 OF 2013.odt merits of order dated 07.02.2017 passed by the respondents not granting all the reliefs as prayed by the petitioner in the representation. If any separate proceeding for impugning the said order is made, same would be considered on its own merits. (S.G. MEHARE. J.) (R.D. DHANUKA, J.) Mujaheed// 2/2
