Heard the learned appointed Counsel for the applicant, the learned APP for the respondent-State, and the learned appointed Counsel for respondent No.2.

The applicant is seeking bail in connection with FIR No. 0138/2024, dated 02/07/2024, registered with Shirur Anantpal Police Station, District Latur, for the offences punishable under Sections 137(2), 96, 64(I), and 64(M) of the Bharatiya Nyaya Sanhita, 2023, and Sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act). 3.

The applicant, a 50 year old man with children, is alleged to have established physical relations with a minor girl of 15 years old girl. Her statement under Section 183 of the BNSS is placed on record. Perusal of the same indicates that the applicant and the victim travelled together to Pandharpur, stayed together in a room, where physical relations are stated to have made by the applicant against the wish of the victim. Considering that the victim is 15 years of age, no case is made out for grant of bail to the Page 1 of
