PER COURT :

The applicants are the legal representatives of the deceased Sunanda Shrikant Jagdhane, who died during the pendency of the proceedings before the trial Court on 8.09.2009. On the date of judgment by the trial Court it was held that the judgment was thus against dead person. The legal representatives are still required to be brought on record. The

applicants are the original legal representatives of deceased Sunada.

There is huge delay in filing the application. It is stated that the applicants were not knowing about the proceedings before the trial Court.

For the reasons stated in the application, the application stands allowed.

4.

Delay caused in filing both the applications stand condoned.

5.

Necessary amendment be carried out in the cause title of the appeal and the application within two weeks from today.

6.

After carrying out amendment, issue notice to the legal representatives of deceased Sunanda, returnable on 4 weeks thereafter.

7.

The Civil Applications stand disposed off.
