Prayer clause-C and D put-forth by the Petitioner are similar to the prayers put-forth in Writ Petition No.6844/2017, wherein this Court [Coram: S.V. Gangapurwala (as His Lordship then was) & A.M. Dhawale, JJ.] passed an order on 12.01.2018 which reads as under:

The petitioner has filed the writ petition with following prayer:

B) By issue of Writ of Mandamus or any other Writ, Order, or Direction in the nature of mandamus the Respondents may kindly be directed to pay him arrears of salary arising out of revised pay fixation, promotion, annual increment and all other consequential benefits for the period from 09.06.1997 till his reinstatement treating him to be in continuity service during the above period, forthwith.

In fact, the writ petition is unwarranted. This Court under orde dated 19.06.2014 in Writ Petition No. 820 of 2001 has

( 2 ) 37 wp 11644.23 observed tha Respondent No.1 shall be entitled for continuity in service and all othe consequential benefits for the period from 09.06.2017 till the reinstatement.

The present petitioner was the Respondent No.1 in the said Writ Petition No. 820 of 2001.

In view of the fact that the relief claimed in the present writ petition is already granted to him in Writ Petition No. 820 of 2001 under judgment dated 19.06.2014. No further orders are required. 5.

The Writ Petition is disposed of. No costs."

Since the Petitioner is repeatedly filing a petition in the same cause, we are not entertaining this petition. The Writ Petition is dismissed. 3.

We may however record that the proceedings initiated by the Deputy Director Education, Latur dated 14.09.2020 indicates that the Management and the Education Officer have been directed to carry out the pay fixation of the Petitioner. To that extent, we expect the Deputy Director Education Latur to ensure that the said exercise is completed within 90 days from today.
