O R D E R

Both the parties are present before this Lok Adalat and submitted the terms of compromise. Same is taken on record and marked "X" for identification.

Perused the said terms of compromise. The settlement is being arrived at by enhancing the quantum of compensation. The terms of compromise are neither illegal nor void. In view of the same, we accept the terms of compromise and dispose of the appeal in terms thereof. As per the terms of compromise, Respondent No.3 - insurance company agrees to deposit the amount in the tribunal within a period of six weeks from today. The said amount, on deposit, be paid to the appellant immediately with interest, if any, accrued thereon.

It is clarified that the amount, if any, in deposit with this Court be transmitted to the Tribunal alongwith interest accrued thereon for being paid to the appellants - claimants there. The appellants - claimants are permitted to make the application before the Tribunal for withdrawal of said amount. The Tribunal, on such application, shall disburse the said amount to the appellants - claimants.

The parties are agree that the amount shall be paid to Appellant No.2 - Syed Ahmed Syed Sadulla for and on behalf of Appellant Nos. 1, 3 and 4 as well. The pursis to that effect has been placed on record and marked "X-1" for identification. The said amount, on deposit, be paid to Appellant No.2 - Syed Ahmed Syed Sadulla immediately with interest, if any, accrued thereon.

Issue full Court fee refund certificate.
