IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.4844 OF 2014 DR. KRANTI SUNDARRAO RAUT

VERSUS

THE SECRETARY, MEDICAL EDUCATION AND DRUGS DEPARTMENT, MANTRALAYA AND OTHERS ---- Mr. A.K.Tiwari, Advocate for petitioner Mr. A.S.Shinde, AGP for respondents ---- CORAM : SUNIL P. DESHMUKH AND R.G. AVACHAT, JJ.

DATE : MARCH 26, 2019 PER COURT Though petitioner had successfully cleared PGM-CET Examination in 2014 and had been placed at Serial No.333, yet, from the final list of the selected candidates published on 05.06.2014, her name had been removed in contemplation of the proposed departmental enquiry against her and it appears, petitioner has preferred this petition in said peculiar facts and circumstances which have been referred to in the order dated 17.06.2014. 2.

Learned Counsel for petitioner states that under the interim order, petitioner had been allowed to join post-graduate

6-wp4444-14 course. She has, subsequently, completed the same and has been awarded Post-Graduate degree in 2017. She has been working all along since then. No departmental action as contemplated, has been moved against her as yet. This petition has been filed with following prayer :- (C) By issuing appropriate writ or directions the list dt.5/6/2014 published by respondent no.4 thereby list of in service Medical Officers who are disqualified for admission to PG Degree/Diploma Courses 2014 be quashed and set aside to the extent of petitioner and further directions be issued to enlist the name of petitioner in the final list for PGM-CET-2014" 3.

Looking to the circumstances under which the petition had been moved and the prayer made in the petition, it appears that the grievance of the petition has been eventually taken care of. No further purpose would be achieved by keeping the petition pending. The petition is, therefore, disposed of.
