Heard learned counsel for the petitioners.

By way of both petitions, the petitioners assail the orders dated 06.09.2022 and 07.09.2022 passed below Exhibit O-6 by the Member Industrial Court, Latur in Complaint ULP No.34/2019 and 37/2019, whereby the complaint filed by the petitioners came to be dismissed.

Learned counsel for the petitioners submits that the action of transfer was initiated against the petitioners on the ground that there was three default and same was based on the circular

929-wp-5264-2023.odt (2) no.2/2017 dated 01.02.2017 and even subsequent also one circular no.4/2021 dated 21.01.2021. Circular dated 01.02.2017 is modified as per circular of February 2024 vide its circular no.04/2024 and it was provided that the action of transfer can be given after five defaults and more.

In view of subsequent developments, the present petitions are allowed. The orders dated 06.09.2022 and 07.09.2022 passed below Exhibit O-6 by the Member Industrial Court, Latur in Complaint ULP No.34/2019 and 37/2019 are quashed and set aside. 5.

However, it is made clear that if the petitioners are due for transfer on account of regular policy of MSTRC, the respondent is free to take a decision in accordance with such policy. (SIDDHESHWAR S. THOMBRE, J.) Mujaheed//
