The petitioner who claims that by resorting the provisions of Section 28 (1) (AA) of the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961 and the Government Resolution dated 04.05.2012, a committee has taken decision on 22.02.2019 and its implementation is awaited. His representation dated 24.06.2020 (Exhibit - I) addressed to the Collector, who has been conferred with the power under the aforementioned provision and the guidelines dated 04.05.2012 has been pending with the Collector since 24.06.2020. Irrespective of the other prayers, the learned advocate 1/2

117 WP 5996-2025 for the petitioner submits that, the petitioner would be satisfied if direction is issued to respondent No.2, the Collector for considering his application (Exhibit - I ).

Considering the fact that prima-facie there is an order passed under the signature of the Collector as head of the committee which is conferred with this inquiry it recommends them an implementation lying with the Collector.

The writ petition is disposed of directing to respondent No.2, Collector to consider the petitioner's application/representation dated 24.06.2020 (Exhibit - I) on its own merits as expeditiously as possible and in any case within eight weeks.
