The learned counsel for the Respondent submits that the present non-applicant who is the original complainant in Criminal Misc. Application No.17 of 2022 itself withdrawn the proceeding on 16.11.2024 instituted under the provisions of Section 12 of the Protection of Women from Domestic Violence Act.

Therefore, in view of above, the cause of action in the present Application does not survive. Hence, it is dismissed as infructuous.
