The order dated 31st March, 2016, passed below Exh. 4, in Petition No. E-69 of 2015, by the learned Judge, Family Court, Aurangabad, awarding maintenance of Rs. 5,000/-p.m. to respondent, is questioned in the present petition.

The only ground raised in petition, qua questioning the legality of the maintenance amount, as is awarded is exorbitant. 3.

The relation of the parties as husband and wife, is not in dispute. 4.

Mr Kale, learned Counsel appearing on behalf of petitioner would strenuously urge that the petitioner is working as a Lab Technician and in view there-of the salary of Rs. 7,000/- p.m., he is getting from his employer,

criwp615.16 (2) is not sufficient to overcome from his liability of maintenance, so also other financial liabilities. He would submit that petitioner is volunteered to pay Rs. 2,000/- p.m., as a maintenance continuously. 5.

With the assistance, I have perused the entire record and the order impugned thereunder. It is required to be noted that the petitioner himself is running a Pathology Lab, as is reflected from the material brought on record, perhaps which was formed to be a basis for ordering maintenance of Rs. 5,000/- p.m. to respondent.

In the above background, no case for interference in extra-ordinary jurisdiction is made out. Criminal Writ Petition fails and stands dismissed. (N.W. SAMBRE, J.) sjk
