PER COURT :- 1.

The petitioner is objecting to the order dated 31st May, 2008, issued by respondent No.3, transferring the petitioner from secondary school to primary school. According to the petitioner, such an order of transfer is against the policy prescribed by the Education Department. An affidavit in reply has been presented on behalf of respondent No.3, wherein it has been stated that, transfer is effected at the request of the petitioner and the office of the Education Officer has accorded approval for the said transfer. Since the petitioner is only IIIrd standard passed and is not likely to compete for promotion to the clerical cadre, there would be no prejudice to him even if he serves either in the Primary or Secondary Section. Writ Petition is devoid of substance and hence stands disposed of.
